The process of drafting a federal constitution for Somalia dates back to 2004 when a Federal Charter and a federal system of governance were adopted in Kenya. The Transitional Charter mandated the formation of an independent commission that would prepare a new federal constitution in two and half years. The Law of the Organization of the Judiciary in 1962 reconciled and harmonized the British Common and Italian Latin law systems of the respective former colonial administrations.
